1.1 “The guardian” is the person who attends The Session with The Player and is authorised by The Parent to do so. 1.2 “Parent” means the parent or legal KFLguardian who will be responsible for the payment of The Fees and who is the contracting party to this contract. 1.3 “Kids Football League or KFL '' is The business Group with whom The Parent enters into an agreement. 1.4 “The Sessions” are the KFL classes you are attending or booking on to. 1.5 “The booking platform” refers to the digital form on KidsFL.co.uk, relating to booking, or re-booking The Player on The Sessions 1.6 “The Fee '' means the monetary cost for The Sessions paid to KFL. 1.7 “The Coach '' means the individual(s) contracted by KFL to run The Sessions. Whilst every effort is made to maintain the consistency of The Coach at The Sessions, KFL unreservedly retain the right to change The Coach where necessary. 1.8 “The venue '' means the site where The Sessions take place. 1.9 “The Player” means the child attending The Sessions, whose details are specified by The Parent on The Booking Form. 1.9 “T’s & C’s” means the terms and conditions set out in this document and any special terms set out by KFL.
2. Acceptance of T’s & Cs 2.1 All agreements related to The Sessions by KFL to The Player are subject to these T’s & C’s. 2.2 Variations or additions to the T’s & C’s shall be deemed to be accepted if The Parent is given 28 days-notice in writing or verbally by KFL. 2.3 The T’s & C’s shall be deemed to have been accepted by The Parent upon payment of The Fee by or on behalf of The Parent. Payment by The Guardian shall be deemed to have been made on behalf of The Parent. 2.4 The Parent or The Guardian agrees to keep the content of KFL sessions and the KFL training program confidential, and not use or copy any aspect of the KFL program directly or indirectly for commercial purposes. The Parent and The Guardian agree not to directly or indirectly manage, operate or assist in the organization of any business that competes with KFL while The Player is enrolled at KFL and for a period of two (2) years afterwards. 2.5 Classes will run for at least 47 weeks.
3. Fee and Payment 3.1 The Parent shall pay The Fee in its entirety prior to The Player commencing The Sessions unless agreed by KFL. 3.2 The Fee is non-refundable except with the prior written agreement of KFL. 3.3 If The Session is cancelled as a result of an ‘Act of God’ (e.g disruption resulting from extreme weather conditions), strikes, terrorist activity, or where the local authority or public guidance advise that travel should not be commenced unless absolutely necessary, then no refunds will be given and it will not be possible to defer The Session during the affected period. 3.4 The Fee will be £30.00 per calendar month to reserve The Players place in that class, regardless of attendance to The Sessions by The Player or the number of sessions hosted in that calendar month. 3.5 In such an event as 4.3, it is The Parent’s responsibility to cancel their direct debit after ensuring The Fees are up to date. 3.6 In the event that a KFL venue or class is closed, KFL will endeavor to offer an alternate class venue, with minimal disruption to their front-end service offered to The Parent.
4. Cancellation 4.1 KFL reserve the right to cancel this contract at any time, before The Player commences The Sessions for any reason whatsoever. KFL shall not be liable for any loss or damage whatsoever arising for such cancellation. 4.2 In the event of cancellation by KFL prior to the commencement of The Sessions by The Player, KFL will refund The Fee for the remaining calendar month. 4.3 To cancel your subscription at any time, please email admin@kidsfl.co.uk with 28 days notice, for avoidance of doubt, written emails must be received on or before the 3rd day of the month prior to your next due payment. If the subscription payment is cancelled via the bank without informing KFL, that calendar month’s Fee will still be owed to KFL. 4.4 In the event of cancellation by The Parent, if less than 28 days remains until The Parent’s next scheduled payment, no refund will be issued, The Player will still be free to attend The Sessions for the duration of the month. 4.6 In the event of cancellation by The Parent, if less than one calendar months remains until The Parent’s next scheduled payment, any Fees owed may be wavered by discretion of KFL.
5. The Parent’s Responsibility 5.1 The Parent warrants and represents: 5.1.1 The information set out in The booking form for is accurate in all aspects and The Parent will notify KFL of any changes in such information as soon as practicable. 5.1.2 When attending The Sessions, neither The Player nor The Guardian will be suffering from any illness disease, or anything similar thereto. 5.1.3 If The Player or The Guardian has any symptoms of Covid-19, they must not attend The Session. 5.1.4 3 If The Player or The Guardian develops symptoms of Covid-19 within 48 hours of attending The Session and receives a positive test result for Covid-19, they must inform KFL immediately for appropriate action to be taken. 5.2 The Parent acknowledges and agrees that The Player shall be deemed to be under direction, care and control of The Guardian throughout The Sessions and The Guardian shall be responsible for the welfare and conduct of The Player throughout The Sessions and whilst The Player is at The venue. 5.3 The Parent shall indemnify and keep indemnified KFL against all loss (including loss of profit), liability, costs and expenses, which KFL shall incur directly or indirectly as a consequence of any action or inaction of The Parent, The Guardian or The Player.
6. Discipline 6.1 In the event that KFL determines the behaviour of The Player and or The Guardian to be unacceptable, KFL shall be entitled to exclude The Player and The Guardian (or either of them) from The Sessions and The venue permanently or for such a period that KFL shall (in its entire discretion) determine. 6.2 The Standard of behaviour which is to be regarded as unacceptable at The Sessions or at The venue shall be determined by KFL.
7. Exclusion of Liability 7.1 Except in the case of fraud, KFL, its Coaches, servants, employees, or agents accept no responsibility under any circumstances for any loss (consequential or otherwise), damage, expense or delay, suffered or incurred by The Parent, The Player or any other party arising directly or indirectly or in any way connected with the attendance of The Player at The Sessions or The venue, or any other act or omission on the part of KFL or any of its coaches, employees or agents. Even if such an act or omission is negligent. 7.2 The Parent agrees (for and on behalf of The Parent/The Guardian/The Player) that any claim by The Parent or The player against KFL or any coach, employee or agent of KFL must be brought within 60 days of the event which gave rise to such a claim. Any claim thereafter shall be time barred. 7.3 The Parent acknowledges, warrants and undertakes (for and on behalf of The Parent/The Guardian/The Player) that the maximum aggregate liability by KFL to The Parent and or The Player under the T’s & C’s shall not exceed The Fee. 7.4 All warranties and conditions, whether implied formby statute or otherwise are excluded from this contract provided that nothing in this contract shall restrict or exclude liability for death or personal injury caused by the negligence of KFL, its coaches, servants, employees or agents or affects the statutory rights of The Parent or The Player.
9. General 9.1 Any notices to be sent by KFL to The Parent shall be sent by email or SMS text message to the information given on The booking Form and shall be deemed to have been received by the addressee within one hour of sending. 9.2 Any notices to be sent by The Parent or The Guardian shall be sent by email or SMS text message and shall be deemed to have been received by KFL once responded to. 9.3 The Failure by either party to enforce at any time or for any period any or more of the obligations arising under these T’s & C’s shall not be a waiver of them or of the right at any time subsequently to enforce all the obligations under these T’s & C’s. 9.4 By agreeing to these T’s & C’s, The Parent grants media consent for KFL, its servants, coaches, employees or agents to capture photographic images or video of The Session which may include The Player to the be posted on KFL Social media pages or KFL website. 9.5 These T’s & C’s constitute that the entire agreement between the parties hereto and supersede all prior agreements and understanding between the parties. It is agreed that no statement promised or inducement, whether written or orally agreed to have been made by either party which is now contained herein shall be binding or form part of this agreement.
